Terms and Conditions of Use and Subscription

These Terms and Conditions govern access to and use of the Weenest platform and the associated subscription services.

1. Identification of the service provider

Weenest is a digital platform designed to facilitate family organisation, parental coordination and the shared management of information relevant to families and parents.

2. Acceptance of the terms

By creating an account or using the Weenest services, the user declares that they have read and accepted these Terms and Conditions.

If the user does not accept these terms, they must refrain from using the platform.

3. Beta phase

Weenest is currently in its beta phase. This means that the platform remains under active development and that its features may be modified, extended or adjusted in order to improve the service.

Weenest will inform users of significant changes affecting the features they have subscribed to.

Each user is responsible for the activities carried out from their account.

Weenest may suspend or delete accounts that breach these Terms and Conditions or applicable law.

6. Family group and the other parent's access

A single active subscription gives access to the authorised members of the family group, including the other parent. It is not necessary for both parents to take out separate subscriptions.

The user who takes out the subscription is responsible for payment towards Weenest, regardless of any financial arrangements they may reach with the other members of the family group.

7. Free trial period

Weenest offers a 15-day free trial period for new users.

During this period the user has access to the features included in the selected subscription and no charge is made.

Activating the trial period requires a valid payment method to be registered.

Weenest will send the user an email notice 7 days before the end of the trial period.

At the end of the free trial, the subscription will be activated automatically and the first charge will be made, unless the user cancels beforehand.

8. Subscription plans and prices

Weenest offers different subscription options:

Current prices are shown on the platform at the time of purchase, together with applicable taxes.

There is currently no permanent free plan.

Weenest may change its prices. Any price change will be communicated to the user at least 30 days before it takes effect, and the user may cancel their subscription before the next renewal if they do not accept the new price.

9. Payments

Payments are processed by Stripe, an external payment services provider.

The user authorises the automatic charging of the selected subscription according to the agreed billing frequency.

Weenest does not store full bank card numbers or security codes.

10. Automatic renewal

All subscriptions renew automatically at the end of the agreed period.

The user may cancel automatic renewal at any time from their account or through the subscription management portal.

11. Cancelling the subscription

Cancellation prevents future automatic renewals but does not interrupt access to the service during the period already paid for.

Access remains active until the end of the corresponding billing cycle.

After that date, the subscription expires automatically and no further charges are made.

12. Right of withdrawal

In accordance with European legislation applicable to distance contracts, consumer users have 14 calendar days to withdraw from the contract without having to give a reason.

The 15-day free trial period allows the user to evaluate the service at no cost and for longer than that legal period. During the trial the user may cancel at any time from their account, with no charge being made.

To exercise the right of withdrawal, the user may send an unambiguous communication to contact@weenest.app.

13. Refunds

Unless applicable law provides otherwise, a proven billing error has occurred, or the user validly exercises their right of withdrawal, amounts paid are non-refundable.

Cancelling a subscription does not give rise to a partial refund of the period already paid for.

These terms do not affect the rights granted to users under consumer protection legislation, which prevail in all cases.

All elements of Weenest, including software, design, logos, content and documentation, are protected by intellectual property rights.

Use of the service does not grant the user any licence or ownership rights over those elements.

Content and documents uploaded by users remain their property. The user grants Weenest only the technical permissions necessary to store, process and display that content for the purpose of providing the service.

16. Service availability

Weenest will make reasonable efforts to maintain the availability of the service.

Nevertheless, interruptions may occur due to maintenance, updates, technical incidents or causes beyond its control.

17. Limitation of liability

Weenest provides tools for family organisation and coordination.

Weenest does not provide legal, psychological or professional advice, and the information recorded on the platform does not in itself constitute evidence or have legal standing.

Users are responsible for the information they enter and share on the platform.

Nothing in these Terms and Conditions excludes or limits Weenest's liability in cases where such exclusion or limitation is not permitted by applicable law.

18. Documents and storage

Users may upload, store and share documents within the Weenest platform in order to facilitate family organisation and the management of information relating to co-parenting.

Uploaded documents remain available to authorised members of the family group while the account remains active or until they are deleted by an authorised user.

When a document is deleted from the application, it ceases to be available to users and no longer counts towards the storage space available to the family account.

Weenest may set storage and file size limits in order to ensure the correct operation, security and stability of the service.

File deletion and technical limitations

Deleting documents from the application entails the deletion of the associated records within Weenest's systems.

Some files stored through external technology providers may temporarily remain in technical storage infrastructure until those providers make available or execute mechanisms for definitive physical deletion.

Weenest will maintain a policy of transparency regarding these technical limitations and will update its procedures when physical deletion features become available.

Weenest will not claim that a file stored through third-party technology services has been permanently physically deleted while that functionality is not technically available.

Retrieving documents

Users are advised to keep their own copies of important documents. Before cancelling or deleting their account, users may download the documents they have uploaded to the platform.

19. Account deletion

Users may request the deletion of their account from within the application at any time. The applicable timeframes, procedures and conditions are described in the Account Deletion and Data Management Policy.

20. Data protection and cookies

Personal data is processed in accordance with the Privacy Policy.

The use of cookies and similar technologies is described in the Cookie Policy.

21. Changes to these terms

Weenest may amend these Terms and Conditions to reflect legal, regulatory or functional changes.

Significant changes will be communicated to users with reasonable advance notice.

22. Governing law and dispute resolution

These Terms and Conditions are governed by French law, the country in which the service provider is established.

Where the user is a consumer resident in another European Union Member State, they retain the protection afforded by the mandatory provisions of the law of their country of habitual residence.
